Filing a chapter 7 bankruptcy on Long Island?-- How quickly can a chapter 7
bankruptcy be filed?
A Chapter 7 bankruptcy can be filed in less than one week.
The documents you need to get a Chapter 7 petition filed fast include:
A list of your creditors - - including the name and address of each creditor (including any secured
debts), the amount owed, and the account number; Your last two years’ Federal and New York
State tax returns; Your pay stubs from the past 60 days; You need to complete the credit
counseling (I will give you the information on taking the credit counseling when you come in for
the free consultation. The credit counseling can be done over the Internet or telephone and
takes 1 - 2 hours.)
If you own a house, you will need your most recent statement (showing the outstanding balance
owed) for any mortgages or home equity loans on your house. If you own a car with a loan, or a
car lease, you will need documentation (i.e. a recent statement) showing the balance presently
owed on the car loan or car lease.
If possible, you will want to file your Chapter 7 petition fast - -
because once the Chapter 7 petition has been filed with the Bankruptcy Court, the automatic stay
goes into effect - - meaning that your creditors can no longer take any actions to collect on their
debts. That is, your creditors will no longer be able to sue you, call you on the telephone, send
you threatening letters, garnish your salary, or freeze your bank accounts.
You have to go to the Bankruptcy Court one time, approximately 4 - 6 weeks after the Chapter 7
petition was filed, for the trustee meeting. (See my Chapter 7 web page for more information on
the trustee meeting). Your discharge order will be mailed to you from the Bankruptcy Court
approximately 3 - 4 months from the date your Chapter 7 petition was filed. (During the time
that you are waiting for your discharge order, your creditors cannot take any action to collect on
