The initial question for many people is - I live in Suffolk County; Should I file a  chapter 7
bankruptcy
?

If you are eligible to file a chapter 7 bankruptcy, you will receive a great benefit from the fresh
start that chapter 7 provides.  Chapter 7 discharges credit cards, medical bills, personal loans,
car repossessions, old utility bills, debts owed to ex-landlords, old cell phone bills and many other
types of debts.  In the vast majority of chapter 7 cases, the debtors keep all of the property that
they own.  So, if you eligible to file a chapter 7-- and can discharge all of your credit cards,
medical bills, personal loans etc.,  and can keep all of your assets, imagine how helpful this will
be.  Discharging your unsecured debts will free up a lot of money per month-- which you can use,
instead, to pay your important living expenses, such as your mortgages, car loans,  current
utility bills, gas for your car, and food.
Typically, you will receive your chapter 7 discharge order from the Bankruptcy Court in less than
four months from the date your chapter 7 petition was filed with the Court.
However, once your chapter 7 petition has been filed with the Bankruptcy Court, your creditors
can no  longer take any actions to collect on your debts-- this is called "the automatic stay", and
it is one of the most important parts of the Bankruptcy Code.  This means that as soon as your
chapter 7 petition has been filed with the Bankruptcy Court, creditors can't call you anymore,
creditors can't sue you, creditors can't freeze your bank accounts, and creditors can't garnish
your salary (If a creditor has already started one of these actions prior to the bankruptcy being
filed, they have to stop it as soon as the bankruptcy petition has been filed with the Court).
Although a chapter 7 bankruptcy will stay on your credit report for 10 years from the date that
the chapter 7 petition was filed with the Bankruptcy Court, you do not need to wait 10 years, or
any amount of time, to start rebuilding your credit.  You can start rebuilding your credit right
away by getting a secured credit card.  Many debtors rebuild their credit after a chapter 7
discharge by getting a new car loan, and making the payments on time; or by making the
payments on their existing mortgages and car loans on time.  There is more information on this
subject on my web page
Rebuilding Credit After A Bankruptcy.
